2. Orders

– All orders placed with TopTimber are subject to acceptance and availability.
– Prices for products and services are subject to change without notice.
– You must provide accurate information when placing an order, including the delivery address and contact details.

3. Pricing and Payment
– Prices listed for products and services are in GBP (£) and exclude VAT unless otherwise stated.
– Payment can be made by bank transfer, cash or other payment methods as specified at the time of purchase.
– All payments are due before dispatch unless other terms have been agreed upon.
– If you fail to pay within the specified period, we reserve the right to cancel the order or delay dispatch.

4. Delivery

– Delivery times are estimates and may vary depending on location and stock availability.
– We will make reasonable efforts to ensure delivery within the estimated time frame.
– Delivery charges will be calculated based on the size and weight of the order and will be shown at the checkout.
– Risk in the products will pass to you upon delivery. TopTimber is not responsible for any loss or damage after the goods have been delivered.

5. Returns and Refunds

– If the products you receive are damaged or faulty, please contact us within 14 days from the delivery date. We will arrange for a return or refund as per your request.
– If you change your mind about the purchase, please notify us within 14 days from the date of delivery. You may return the products in their original condition for a full refund, excluding delivery costs.
– Returning Unwanted Products: When returning an unwanted product, the customer is responsible for either shipping the item back to our yard at their own expense or paying an additional fee for us to collect the item from their location.
– Custom-made products (e.g., bespoke timber panels) are not eligible for return or refund unless faulty.

6. Warranties

– Products sold by TopTimber come with a warranty against defects in materials or workmanship.
– The warranty is valid for 12 months from the date of delivery, and only covers products used in accordance with the manufacturer’s guidelines.
– Warranty claims must be submitted with proof of purchase and a description of the issue.

7. Liability

– TopTimber will not be liable for any indirect, consequential, or special loss or damage resulting from the use or inability to use our products.
– Our liability to you for any claim arising under these Terms shall be limited to the total value of the products purchased from us.

8. Force Majeure

– TopTimber will not be liable for failure to perform or delays in performance due to circumstances beyond our control, including but not limited to natural disasters, strikes, accidents, or delays in transport.

9. Privacy and Data Protection
– By placing an order with us, you consent to our collection and processing of your personal data in accordance with our Privacy Policy.

10. Timber as a Natural Product

– Timber is a natural product and may contract, expand, and distort with the seasons.
– Split, cracks, snakes, and fissures may be present in the timber and are not considered defective.
– All timber products are nominal size.
– Timber products are suitable for external landscaping use only.

11. Changes to the Terms

– TopTimber reserves the right to update or amend these Terms at any time. The updated Terms will be published on our website, and the “Last Updated” date will reflect the most recent changes.

12. Governing Law

– These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
– Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
